    yer fair enough, if he was by himself I wouldn't be so judgemental. But having two children of my own aged 2 and 5, I know what he did was just plain wrong. Sif risk kids lives in an open tinnie in the bay with the weather being as unpredictable at this time of year. If anything the weather around that time was around the same every day. The winds were blowing up strong Very early at least 3 morns preceding the day he took a run for it. He shoulda damn well known better. And I believe that doing something that stupid deserves some sort of punishment. ffs 2 innocent lives coulda been lost, And the dill doesn't remind me of the type that will learn anything at all from this, 12 yrs experience lol. Blamed everyone but himself. Throw the book at him I reckon. >

    Phil, interesting subject and I personally believe that boat and motor vehicle licences should be considered the same. It may be already but I cant find anything to support it.

    Section 79, 79A and 80 of the Transport Operations (Road Use Management) Act 1995 outlines the provisions in relation to offences concerning drink driving.

    This Legislation is the same whether you are in charge of a car, truck, horse, dog, cow, boat or whatever, even roller skates. If you are in charge of anything it's the same.

    Only thing is, you dont lose points for drink driving. The beak either takes your licence completely or not.

    I don't know how the law stands, but it's an interesting thought. I hope they disqualify him across the board.

    This idiot should not even be left in charge of a whipper snipper

    I am still amazed he has said he is a trawler skipper, it's only made himself look even more stupid (maybe it sunk in bad weather after running out of fuel).

    Heard a story from the other island to the south that fuel goes missing from tote tanks of a night, the fumes are in high demand by the capful [smiley=beatnik.gif] not saying thats what happened but could account for a couple of litres short.

    I have 2 employees are on jury serivce over next 6 weeks they might get on the jury for his case both have young familys and into boating
    will see whats happens you never know

    When this story first broke in another thread I replied to the effect that the guy was just trying to do good by his kids and may have been on a timeframe to return 'em. I also ended with something to the effect that sometimes the best of intentions just aren't good enough. Most wars are started by leaders who think they have the best of intentions.

    I can see both sides of the argument here and being an ex adventure training instructor I can even manage a wry grin at Rob's responses. Jeeeeeeeez, I even allowed myself to be dragged around behind the tinny just to have the kids laughing the other day. I don't want to end up in a retirement village thinking that I never got a thrill from taking chances either. There's an old RM saying, "faint heart never f****d a billy goat", which means simply that you do what you have to do or feel like doing, and damn the consequences. Now this is ok if it involves you, and only you, but when it can alter outcomes for others, then you leave the billy goat alone, OK?

    Ask yourself this. Were the kids asleep or just curled up on deck sick as dogs? Just *how* experienced (or honest) was the guy, if he tries to shift blame for his lifejacket choice, onto the shop that sold it to him? That's bloody basics people and if he doesn't know PFD selection or is prepared to cut corners for those he is responsible for, then he will have to suffer the consequences.

    Only those who know the guy personally can answer as to his honesty/intention but rest assured, unless the guy is brain dead he would have suffered, and probably still suffers some terrible moments out there. The moment you reach for flares you *know* that you're in the shit and to have no response to those flares and then have to resort to a phone can only have filled him with dread. He would know full well that the wind generally increases as the day draws on that more time would elapse since he first flared and that nobody was yet on their way. He would have been scared shitless for both him *and* his kids. Isn't that punishment enough?

    You need to know the guy to allocate punishment. That is why they have social reports before sentencing. I'll find him guilty but I won't sentence him as I don't know enough about him.

    I hope you will do the same for me if I ever "go adrift".

    Think i'll side with the whingin pom on this one ..No offence kev just joshin about , and agree with what yourve said..
    The fella in question may or may not be worth throwin the book at but i dont know enough about the situation to pass judgment and if your asking me to believe what the media has written ?? i'll pass thank you very much as we all know the works of the media to date and they do have the power to place a brand on one that can be permanent innocent or not??..
    I suppose at the same time none of us has exceeded the speed limit on the road with others onboard intentianally or non intentionally but thought nuthin of it cause they just didnt get caught or any fuss like this one been made up..
    None of us are aware at how it can be flat as mill pond one minute and how quickly the southerlies as some get further south can pop up out of the blue or if one hasnt a reasonable marine radio to pick them up as they head up the coast.
    Heads up cause there will be more getting penalised for simmillar offences in times ahead cause of new attention being aimed at waterways..
    How many book on charters and the rule is ˙ou cancel because of weather, you lose deposit.We cancel , you get refund'and so the Charter heads out under quite rough conditions .
    Nuthin more heard.
    How many drive their boat ahead of a charter for a stay at an island for week or two under very rough conditions??....
    Feck they must be good skippers ey!! ...
    Anywäy good to see we have so many experienced Judges n executioners onabord ..Just hope the fella's kids in question dont have to face other Kids at School sayin " Your Dads the Dikehed bein talked about on fishforums, aint he??"......
    And i must say i do know my shite stinks cause i dont think me heads that far up my acehole that i cant smell it..No offence anyone, just like to think someones innocent until proven otherwise and think the fella in question is gunna have enough on his plate legal wise and otherwise without me adding to it ..

    sorry volvo,i`m at a loss to grab your comparison of tinny to a charter boat sea worthyness and boat capabilities obviously a lot different,we are passing comment ,the courts will judge and penalise .cheers alex
