    VERY INTERESTING AND EACH CASE TAKEN 1X1, RESPONSIBLE BOATIES DON'T TAKE RISKS AND LET'S BE REALISTIC YOU CANNOT JUST PULL OVER OR GET UNDER COVER TO RIDE THE STORM OUT, WHEN YOU CONSIDER THE NUMBER OF BOATIES THAT USE THE WATER WAYS THE STATS I FEEL ARE GOOD. SO MAINTAIN SAFETY GEAR AND NOT BECAUSE THE REGULATIONS SAY SO, AND SIZE UP THE SITUATION/RISK WELL IN ADVANCE AND REACT.

    H ave read the whole issue , (sore eyes), but, your advice is usually good WESTIE, pages back you sparked my interest, my first thought was " if the kids were asleep it couldn't have been that bad", also read all of subzero's 1 fingered novel, well done bloke, me a newby too........... you have to wonder how an experienced seaman found himself in that position........wrong spot, wrong time , ooops, happens to me on the computer all the time because me have no REAL experience, ??? I' ve made mistakes too, caught out on the wrong day, have been caught out on the right day!! Isn't that why we ALWAYS carry far more fuel & water than we need?? Came home to ballina after a big trek around, only to find the bar unpassable, was a beautiful day at sea, still had to have fuel to travel another 20 miles to the next available port ( evans head )I don't know your area, but from what you all say , it sounds like it can get dodgy.! Thank god they all got home safe......., muzz.

    You are absolutely correct.

    I can't believe so many people are making excuses for this man's behaviour.

    It was one thing to put himself in danger, but two small children!!!! As well as the people that had to go and rescue him. Thats inexcusable.

    The police have done the right thing. Good on them![smiley=2thumbsup.gif]

    The fella was unlucky, a slap on the wrist would have been plenty, maybe used the money from the court case for some top line safety gear something actually worthwhile, to many dam rules spoiling everything.

    Maybe we should do the same for car thieves, armed robbers and burglars to, slap them on the wrists. Do the wrong thing and expect to face the consequences according to law.

    I'm sorry i have to totally disagree on that...as an ex cop

    he was lucky to be rescued....he was lucky his kids didnt drown...and he was lucky that he had a reasonable boat that stayed afloat.

    " a Slap on the wrist"???...you dont get one for being reckless in a car....even if you dont kill anyone, so why do you get one for reckless endangerment in a boat???

    there are too many slaps on the wrist for this sort of thing...thats why people continue to do the exact things he did, no adequate precautions were taken.

    i see people complain about the amount of rules, and the continual restrictions we and other uses of roads and waterways cop.

    But for god sake ...if we everyone obeyed the lesser rules in the first place, there wouldnt be larger rules now.

    i didnt listen to the Media reports fully...and have looked closely at what has been typed here.


    the basics are he wasnt prepared, and he put others in danger

    In my book thats reckless endangerment...and should be charged accordingly

    Which now brings us to the point of :-

    If one loses their motor vehicle licence for drink driving, they also lose their other licences, including the ' boat licence ". SO;

    If this feret goes to court for an offence regarding his driving behaviour, or lack there of, does he lose " points " as per his drivers licence ? Answer............NO..........my question ? Why not ?

    Is the offence a criminal act, and if so, so is drink driving and points or whole licence is lost for that ? Food for thought people.

    Seeing our boat licence is a " virtual' one, should it come under the umbrella of the Drivers Licence, regarding the points system ?

    Does anyone know the real story or facts pertaining to what I have just dribbled out ?

    the rules change from State to State

    but basically if you place the lives of others in danger...through your own actions...then thats enough

    to be absolute...you need to look up the local police act

    You blokes are quick to judge, not sure what good any of these rules does anyone, in the longterm your just going to end up being spoonfed in a retirement village without a scatch on you lol.

    Lets look at another possibility , it was 4 am when i left for the same area (i live "IN" Moreton Bay) and it was like glass. By the time i put my boat in and got to the tip of macleay island all hell broke loose.

    This was in the time frame of about 30 minutes, now for arguement sake this guy was on Moreton and woke up to a flat sea..(wich it was with no wind AT ALL) and decided that as usual the BOM got it wrong.

    I mean he headed off at the same time as i did as it was PERFECT and got into trouble 2 k's from his destination.

    You never learn anything in life unless you make mistakes, if you haven't made a mistake in life you haven't lived it. Lets be real here, how many times have you been out and had to come home when a wind has shifted the opposite as it was predicted?


    And for arguement sake i went home of course as the conditions got worse, i even picked up debri from the blokes boat who sunk near peel.

    BUT i dont think it was an option for this bloke as he was in the point of no return bracket and would have left Moreton in perfect conditions.

    Ps it was spose to be blowing 25 to 30 knot winds here in the bay this morning. At the moment it would be lucky to be blowing 2 where i am.

    Throw the book at him if you ask me.

    If for no other reason than him trying to blame BOM. He indicated that it was their fault as the wind was over the forecast. As I recall, it was something in the 40% stronger than the forecast range. We all get caught out sometimes when the forcast unexpectedly changes, but you can't say it is all there fault. Anyone with any experience knows that. And he said he has 12 years.

    Anyone that has 12 years experience and does not know which life jacket to use, happily takes their kids at such a young age to morton in an open tinnie and does not fully check out safety requirements, tries to blame the sales assistant for something he should have known "with 12 years experience and the safety of his children at stake", and then does not take enough fuel,,,,

    I fished in and around Moreton Bay for over 30 years and know how quickly it can change.

    If the sea was glassy as you said and this guy took off in those conditions, then he would have had a bit of a run across part of the bay with ease. He then ran out of fuel when it blew up.

    Makes me wonder just how much fuel he actually did have when he set off. I bet it wasnt enough to get him back even in good conditions.
