    NOT HAPPY JAN.......

    Saw a boat for sale in popular advertising mag at a reasonable price so i
    rang the dealer and was told by salesman ' sorry it's sold.'
    Two weeks later same dealer has same rig ..this time price is $7,600 more than first advertised!!
    Where do they stand legally and can they be forced to sell at original price....
    [consumer affairs or B.I.A be of any assistance.]

    try taking the original add in if he is reputable he should respond but sometimes the mags do misprints of prices

    Hmmmmm...move on Linkman...only grief and high blood pressure awaits to try and persue it...could be a squillion reasons put up...the learning is to give that dealership a wide berth in future...

    Sounds like it may have been a misprint, but if so the dealer should have said so an not said it was sold.

    Could be 'bait' advertising which is illegal, and also misleading and deceptive conduct. Something for ACCC and Office of Fair Trading to pursue, and they could face a fine, but there's nothing in it for you to pursue.

    Maybe the original price was the cost/price they paid.. I.E. - THE $7,600 was their mark-up [profit]

    I think that an advertised price is actually "an invitation to treat" which means that if you offer them that amount they may sell it to you. This is like a price tag on a garment. If they have made a mistake then they are not obliged to sell it to you at the indicated price. However, "Bait" advertising is certainly illegal and should be reported. You will find that other dealers will pick up on this pretty fast if they are making a habit of it as it will effect their trade. This only my opinion but I doubt that you can force them to sell it to you.

    Maybe it was sold the first time and back to be resold...there could be many reasons..I would not waste any time over it..just move on.

    i dont think you can get it for the original price, if it was a typo, i think they just have to make an apology in the newspaper or something.

    Agree with Revs on this one.

    If you are 100% sure that it is the same advertised boat, (without extras eg. radio,sounder,lights,canopy etc) perhaps giving the dealers name to other boat buyers would also help them in making an informed decision on whom they do business with.

    Mousetrap is correct in that a price is an "invitation to treat".

    I have known in some trading that when the market is "volatile" then dealers will advertise at a given price to "invite interest". If many parties are interested they then get an idea of the possible market and will up the price to meet "market demand". IOW they have absolutely no freakin' idea what something is worth and want you to tell 'em. Then they stick some more on!
