Trailer rego

I've been told this trailer doesn't need breakaway brakes, and it has only overide brakes.
Registered pre 1980 and doesn't need to meet current standards.
It is a twin axial galv trailer with a Haines V213c on it.
Anybody know if this is correct?

I would honestly upgrade to breakaway brakes, I know there is ADR exemptions on trailers made or imported before that year but there is another issue where your insurance may be void as it may be considered unsafe or overloaded.
Whilst your looking at it check the rims and tyres for their ratings as they possibly have been changed in that period to a lower rating, if so you would have to still go down the path of changing them over to meet the ATM rating.

Going by your ATM rating i would think that Yes you do need Breakaway , as Dig said , If you had an acident on the Road you may Void Insurance or be considered automatically in the wrong ??..

Yea, it doesn't sound legal to me, i didn't buy it, a mate has. The roadworthy bloke gave him a roadworthy certificate to transfer. Like yous are sayig insurance, all things may be easy, until God forbid someone dies.
The only boat i had prior to 1980 was, i think a tinka, a 16ft, single axial with hydraulic disc overide setup.

yeah, good luck with that in a court of law. But, of course there are exemptions for a host of rolling things built before a certain date, like seat belts, indicators, etc. So maybe it would stand up?

The breakaway bit of EOH is, to me, the least important part of it, although, of course, a requirement. The extra braking power of EOH over over-ride has to be experienced to be believed, for those that have never had it. Add to that the ability to brake independently on the trailer , if required. I went through a set of pads in the first year on the Reefrunner, because the Patrol actually stopped quicker with the boat on the back and the Towpro dialled up than it did with no boat on the back. I dialled it back when I got the D-max, get two years now. And yes, they are more expensive to maintain, etc, I understand that.

Irrespective of good practice, your 1980 trailer only has to comply with the relevant regulations in place at the time of its manufacture.

However, I wholeheartedly agree that it would be a very good idea to make it compliant with existing criteria to avoid potential problems in the event of an accident.

At the very least, you should make full disclosure to your insurer and obtain their fully informed consent that the trailer meets requirements of 1980, but not necessarily current requirements...

Insurers are notorious for getting out of paying claims if there is the slightest chance they can.

To the best of my knowledge, changes to trailer build regulations are not retrospective.
