    Yes, is to be changed very soon. All it means is that the employee should only be able to lose super associated with unpaid wages, rather than a quarter's worth, as is currently the case with employer contributions, where they typically pay quarterly.

    The mention of "trading whilst insolvent" is relevant--that is an offence under the Companies Act. And when things are going under, and there is not enough to pay the bills from cash flow, the super contributions were usually the first obligation that went unpaid.

    You can imagine when times get tough and you need to get a supplier off your back until a boat is finished, when you only have to pay Super of your employees every 3 months, it would be easy to push the super payments to 3 months down the track. Soon, as each lay goes in to your account so does the super automatically. So if employees aren’t getting paid, things “should” be able to be pulled up sooner before potentially months of unpaid super is down the toilet when the employer goes under.

    Thought the Gov would have laid down some ground rules by now from this sort of thing happenning or at least people getting legal advice prior to entering into a purchase plan.
    This was common back prior to my purchasing my Van in 2014. Quite a common discussion in the Carsvanning Forums/Cominity.
    Yet on it goes ??
