    Exclamation flare expiry date

    who know's the legality of the expiry date on flare's ,
    when stated as 11/09 . i take this to be to the end of the month not the first day of the month, has any one had an issue with this before as i am interested to know .....
    i rang the coastguard ,dept trans marine section,dpi and found it hard to get any direction but in the end fisheries advised that there is no rule but they state verbaly that its the end of the month for expiry of the flares in mention....

    not too sure, but I guess if we are talking days, then why put off buying a new set?, you will pay soon anyway, and may just save yourself a bit of "discussion" with the Authorities.

    A Watercop who was inspecting my safety gear told me it was at the end of the month marked.

    no the fishing comp river to reef is on next week end and need the cash for extra fuel...but is a good point

    i must say when buying flares you need to be able to go through them or ask the sales person(as flares are under lock n key) to check expiry dates as some people like myself get stuck with the ones that are half way through expiry
    BUYER'S BE AWARE and check the dates before purchase!!

    oh yeah, seen that one before, flares that are up to a year old still for sale as "new", most do not check, they just buy and walk away.

    Yeah, I was pretty a*rsy the other day, went to Whitworths as my flares had expired Oct/09 and they just got in a brand new shipment and were unpacking it on the bench. New flares manufactured Oct 09 expire Oct 2012- good for a full 3 years!

    Division 8 Expiry date for safety equipment
    41 Expiry date for particular safety equipment

    (1) This section applies if a ship is equipped with any of the
    following safety equipment for this part—

    (a) an EPIRB;
    (b) a fire extinguisher;
    (c) flares;
    (d) a life raft that is inflatable;
    (e) a PFD type 1, 2 or 3 that is inflatable;
    (f) smoke signals.

    (2) The safety equipment mentioned in subsection (1) must show
    a legible expiry date (however described) for the equipment.

    (3) The equipment must be serviced by the manufacturer or the
    manufacturer’s authorised service agent, or be replaced,
    before the expiry date.

    (4) If there is a failure to comply with subsection (2) or (3), the
    ship is taken not to be equipped with the safety equipment.

    It wouldn't be the 1st time that water police had a different interpretation/view of a regulation to that of boating & fisheries patrol!
    Probably safer to replace epuipment before the expiry date then you know you're complying with the regs.

    It is a bit of a grey area Seatime, but I am going to follow it up. It is more the discretion of the officer I think, which is not good on both sides. One person might be a little more lenient than the other. and I can see someone getting caught out by this, but it is there in writing.

    when i called the goverment dept's they had no idea of any legislation requirement......i think they need to know the rules as well DONT YOU.....

    so, according to the laws, they must be replaced BEFORE the expiry date, that being the case flares that expire (say) Novemeber 2009, must be replaced today or tomorrow at the latest to fully comply, now I would be thinking that if you got pulled up (say) in a weeks time, unless you were being a smart ar$e they would give you a friendly word of caution, but if they wanted to get you because you were being difficult, then they may just nab you!

    The expiration is the end of the month stamped. November 2009 flares are perfectly legal up until and including the 30th of November 2009, but will fail to meet the requirements come 00:01hrs on December 1st, 2009.

    Same as any pharmaceuticals - they generally only have the month and year... and you can use them in that month, just not after. Once our drugs have expired, we send them to our neighbouring Pacific countries where they are good for another 2-3 years.

    don't see it that way myself, it states that they must be replaced BEFORE the date stamped, so in that case they expire at midnight the night before the month of printed/stamped expiry.

    Well I looked at my flares and they are exp 11/09 so I guess I will be going to go get some new flares. Just another excuse to buy more fishing gear

    On a side note, where or how should I dispose of the old flares??? Just not 100% sure
