    Not fisheries here but at an island half way across bass straight. Brother was in a boat from Victoria and fisheries wanted to inspect their catch by boarding in heavy seas. Driver expressed concern at being holed by their boat and as captain ordered them to stay a distance away. They insisted on one person boarding and then the other kept his hand on his sidearm as his mate was on board, while keeping the fisheries boat close by. It took over an hour for them to remove all the crayfish from their individual hession bags and sit them in the sun (the crayfish) and OK their catch. They then let them on their way (after the long 1 hour perdantic check). Maybe it was because they were victorians pillaging their Lobsters that were soooo much bigger and their bag limit for 2 day trip was more than worthwhile. Maybe it was the initial attitude they received but it was more attention than they had ever received on previous trips.

    the sticker about number of passengers is a GUIDE ONLY. Technically you can have more in your boat than the guide states SO LONG AS YOU HAVE JACKETS FOR ALL ON BOARD. It comes down to number of Jackets.

    AHH I don't think that is the way it works.

    So my boat is plated / stickerd for 5 persons........if I have 12 life jackets can I have 12 on my boat....I DO NOT THINK SO.

    The stickers is a guide.....the number is a maximum and only for smooth waters.

    That is so wrong.

    All newer boats have a builders plate that states the maximum number of people allowed on the boat in smooth waters.

    The capacity sticker is mandatory if you dont have a builders plate.

    The back of the sticker has a chart to work out the maximum number of people allowed in smooth water.
    This is to be reduced by the discretion of the skipper in rough water, or waters other than smooth.

    The maximum capacity sticker is law and should never be exceeded.

    I was under the impression that it was a guide only, the capicity is to do with flotation in the boat with the adverage person counted as 75kg, if you go by this most boats will be overloaded if you have a boat rated to 4 people and 4 guys on board

    If an accident was to happen you would be charged under the unsafe operation of a vessell and not ensuring the safety of the passengers rather than being over capicity

    The capacity label ( sticker ) is mandatory for all boats to my knoweledge and must be plainly visible from all driving positions and within 1m of the driving position.

    The give away is the words on the sticker.

    "MAXIMUM CAPACITY : NUMBER OF PERSONS
    (Smooth waters only)

    "Warning: 1. this is the maximum persons capacity in SMOOTH WATERS. A reduction in maximum numbers MUST be made in adverse weather conditions or when used in partialy smooth or open waters.

    So if you boat is plated for 5 and there are 5 aboard and you are stopped off the back of green or over at mud, you can be zipped for overloading.

    the capacity is worked out on the basis of 75 Kg per person and 15Kg of personal gear per person.

    The capacity on the label does not account for equipment in the boat, or weight added to the boat after manufacture, and it certainly does not account for um... er.... ooo...... larger than average persons.

    So.. a 12 foot tinny rated at 4 persons by the plate.
    if you have trimmed the boat out with a casting deck and some gear and fuel, add two large blokes 110Kg (these blokes still arent whales) some fishin gear and a respectable esky...... and your capacity is busted.

    just for reference a slab of beer wieghs about 10Kg and a slab of pillies weighs 15Kg.

    If you don't have a capacity label on you boat...... do not think twice...don't think you arent required to have one ........ get one from main roads and stick it on.....if you get pulled up it is one of the first things they look for.....i've been pulled up twice in 6 months.
    If you don't have one they WILL zip you.

    They cost nothing, all you have to do is ask for one at main roads, boating and fisheries or a variety of other places.....even archies boat licences keep a stack on hand.

    I got pulled over at Patts point at dusk last year. Just on. They called us along side to that Police Barge. It was quite lumpy and the side of our boat 15' tin can rammed into theirs. It went to do it a second time and I tried to fend us off and slipped on the side of their boat and almost went over the side. After a few choice words to them about the stupidity of their request they then threatened to take us ashore if we didn't quieten down. I wanted to call their bluff . They provided no fenders or anything. My mate just wanted to get away from them. He was so upset we went back ashore after the incident. Wont happen next time.
