    What If ?

    What if:

    Your boat is licenced to carry 6 people...

    You have 6 people on board...

    Fisheries come along side and want to board your boat...

    Can you refuse them the right to board your boat on the grounds that it would be overloaded and illegal if they do?

    Good one if you were a Safety Officer you probaley could book them ................ Did i hear a while ago how a police officer booked a safety officer for speeding in turn he booked the copper for not wearing a safety vest?????

    I suppose they could ask one of the 6 to get on their boat, so that they could board yours. Then I guess you refuse to do that too.

    Either way your rego would probably be recorded in the black coloured book for future reference.

    It is a serious and reasonable question.
    There may be some sort of exemption in the act....... but you would be wise to mention it at the time..... likewise the life jacket question posted a couple of days ago.

    boat capacity 6, 4 aboard, 4 life jackets.........inspector wants to board...... fine mate but bring a life jacket.

    Maybe it would be a good thing to keep a sheet of the number stickers that you get with the capacity label on the boat at all times.

    Peel the existing one (6 people) off in front of their eyes, replace it with a new one and tell them "Sorry guys, no can do ... only legal for 2 people today"

    IMO you would be best to work with them rather than hinder them.

    If they were smart they would direct you to the nearest shoreline so you can dissembark the POB's then go thru you with a dose of salts

    Yes, working with them is advised as they always have the upper hand if needed.

    You are right Garry, they would probably direct you to land.
    That would be great if you were out on deep Tempest

    What other things could you do to really pi$$ 'em off?

    Cut all the fins off your fish, including the tail

    Put your rego numbers on in mirror image

    Put all your fish in hessian bags ... remember the bag limit is 5, so carry plenty of bags and never put more than 5 in each one

    If you have children on board, ask them to show their blue card (working in close proximinty to children - yours). If they don't have one, they could be in breach of the relevant requirements (so I was told). Skipper responsiblity to the safety of vessel and passangers could mean that you should not let them board for that reason.

    I wouldn't try it though............

    As an ex pro, I can assure you that these questions have been pondered long and hard.

    I've had fisheries approch and board us while committed to a turn during trawling operations. They came up between the lines in a RIB and over the side in the middle of the night. They've seen and heard it all.

    I would say though Pete, that if you delivered the line well enough, there'd be nothing that they could do at that time.

    It is an interesting one!

    Not sure of what the go is in Queensland, but when I have encountered fisheries people down south, for one they are always wearing life vests etc and have never requested to board the boat, but have inspected papers and catches etc from their boat alongside.

    While I read that people (above) have in fact been boarded I am surprised; as I would have thought that would be a no-no for their OH&S policies and that they would be more likely to direct you to land.

    If however as person in charge of the safety of persons on your boat I would think that you would have good grounds to refuse a request to board if you felt it not to be a lawful order in that it would compromise the safety of the vessel.

    But then, of course, be prepared for a thorough search when you hit the bitumen.....

    Chris, up this way and at the time, we were pulled up by 2 guys in a rib, no jackets on, and yes asked if they can board my boat, same thing happened at the Mission Beach M/G that we had, but this time there was 2 guys and a young lady

    A little of track but does anyone know what the deal is with boat capacities, one being day time and one being night time. I saw it in this link put in another post..hope we do not have to deal with this now also??
