Doesn't matter what sort of a twist some want to put on it, if the plate says 40hp then a 50 on the back exceeds the plate, it is this simple and all the "she'll be right mate" comments are really irresponsible!
If 50 is suitable it is totally up to the manufacturer and nobody else and if so the manufacturer will authorize it, either new plate or in writing.

Nine Lives, lets look at problem#2, as the others have dealt with problem #1 to death.
Sounds like engine is too high on transom. Try droping one hole and try. Cav plate can be up to 25 mm above bottom of boat, unless there is a pod. Job can be done at home, but get a mate to help. PM me if you need some tips. Cheers Pete.

Yep, the max is the max and there is no mistaking that. Many manufacturers only put max hp. Some put max weight also.
Ozscott, that case you are referring to sounds like an odd outcome as the drunk driver should not have been on the road and hence all responsibility for what occured should fall on him as he should not have been there. And had he not been there there would have been no accident. Obviously there is more to the case.

Im looking at a similar dilemma. The boat I own is a US bass boat and has a plate saying max recommended horsepower is 75hp. It has another plate saying that the max transom weight is 390 lbs. On their website there is a pic of the boat with a 90hp optimax on it. It just fits the weight range so I can only think that the extra thrust from the motor would push the boat faster. The motor would be raised anyway to maximise performance with a stainless 4 blade prop so there would be less drag.
As for the cavitation issue, I had problems with my stessco tinny last year. I put a foil on it and all it did from then on was porpoise. I would suggest going to a higher cupped prop or a 4 blader as they hang on for grim death. If your willing then you can lower it. Whilst doing performance propping I found that my cav plate had to be skimming the surface. Maybe just get a better prop and you might find the speed gets better as well as the handling. Solas and Turning Point would be names to try

40 50 same weight get stessco to uprate it they did it for my 480 outsider from 50 to 70 and buy a permatrim they are the only foils to bother with

BM - no mate. Its a common fallacy that if your drunk your gone for all money because you shouldnt have been on the road at the time...Im a barrister so Im not talking out of my arse about this. The same comment applies to insurance...if your sitting at the lights legally waiting for the red to turn green, say in broad daylight comatose and your hit from behind your insurer cannot legally drop you.
