    Poor Sevice personified

    A mate of mine purchased a boat (no motor) on Ebay. He looked around for a carrier to get it up here and was helped by the vendor who recommended a carrier whom he had used.
    The chap couldnt do the job but in turn told Darren to contact a carrier who has a Depot in Toowoomba . The manager( or claims to be the manager) of ### readily accepted the job and gave a travel time of 36 hrs, the boat to arrive at Morayfield Tuesday 23/03.
    According to the vendor the boat was collected Wednesday24/04 at lunch time.
    The Manager,
    has since that time ,
    refused to take calls from the new owner , or hung up in his ear
    been extremely abusive to both the new owner and myself for trying to ascertain the whereabouts of the boat ( My company financed the purchase)
    Lied about the time and date the Item was collected for delivery.
    Told us the boat left Melbourne last mon 02/03 lunch time
    lied about the ETA consistantly. Told us the boat would be here Tueday night, or Wednesday before lunch
    Promised delivery today,,,,, and failed to deliver the boat.
    Refused to allow contact with company directors except via email ( I suspect the email address is his own)
    Refused to divulge the company directors name or address.
    ######## have had posession of my clients boat for 8 days and refuse to deliver it, or tell us its whereabouts.
    I had originally intended to name the company in the hope it may save someone else as much trouble as possible, however given the litigious nature of society today I thought I had better not put myself or Ausfish at risk.
    I would dearly love to tip a bucket on this bloke but my solicitor advised against it.
    sorry for the ramble on ,,, feel a bit better now.

    The moral of this story is: get the details and get it in writing.

    My client is a straight shooter, and a typical "aussie good bloke" I guess he expects everyone to be as fair-dinkum as he is.

    That's a shocker, what sort of cartage money has been put down? and did the boat have an insurance cover-note.
    I had an uninsured car go missing in transit for 6 days, there was also no paper trail nor reciept apart from my credit card, to say I was worried was an understatement.
    I suspect sometimes carriers look after their big paying mates so pull a few games along the way to ensure the bigger dollars don't get missed.

    It's not nice but it is business in Australia.

    Best of luck hope it will turn up, even if in the carriers good time .

    C.O.D, $2K no papertrail,, Ill bet you he will deny any wrong doing .
    Through my business I have access to business registration data , ABNs , directors etc. First thing next week Ill be on the net finding out who the real boss is .
    I wouldnt be supprised if the company doesn't even know this boat exists, and he is trying to pocket the cash.

    Hi Rando...you must must know someone living in his area who would pay him a polite visit and make him see sense...I think if i was in your situation i would be travelling down and sorting things out personally....Low life scum !!!!!!

    sounds like typical transport ....a boat is not an item they like to carry...all volume and no wieght so they like to put it on as top load...but to do that they need a solid load on the deck first...I suspect he is waiting to have sufficient deck load so that he can put the boat on as top load ...makes the trip more profitable.

    Report it to the police. If that bloke has your property and is not delivering it, it has been stolen.

    If anyone lives nearby? perhaps through PM for particulars they could go for a drive and have a gander at the depot? a photo would be good if the boat can be seen.

    It was supposedly being carried with three caravans for delivery to Morayfield but the germ let slip that the caravans were delivered wednesday. So how it was arriving in Toowoomba last night when the caravans were in Morayfield I cant figure.
    Ive advised my mate to get the police involved,but he says if he can find out where the boat is he will drive down and get it, even to Melbourne.

    Ive never seen him get angry though.One of those gentle giant types.

    Im off to make a coffee, I might ring him and see how its going then.

    He is trying to get the boat ready for Fraser comp, we probably wont make it now. Bugger were were hoping to get stuck into the reds out from DI.

    after dealing with many transport companies i agree with pinhead that more than likly the boat is sitting in their holding depot waiting to get a full load before travliing to make the trip more profitable
    this situation reallly is a pain but many companies do it also thay support their regular client s first over one off customers so priority is low
    but as for your treatment by the allgedged manager is qiute poor and you should stick it up him write the f******r a rubber chq let him ring you
    i personally would be giving them a deadline for a reasonable delivery time then then consolting a solicitor as if your paying 2000 for deliver im sure the boat is worth a bit more then report it stolen get the insurance company involved there a mean bunch if your on the wrong side when it comes to money

    but there are a couple of valid points already raised,,, my money is on one in particular,,, and thats simply,, its awaiting additional freight to make the transport costs more profitable,,,

    if as you stated it came from melbourne with a couple of caravans,,, theres only a couple of yards in the morayfield/burpengary area that would fit into this picture,,, theres kratzmann on the highway,,, another is part of the Carmart enterprise in morayfield rd,,, and i think theres a further one thats part of the industrial estate,,, check these guys out as well,,, and see if they in turn use this bloke often,,,, get a whole picture of what he's really like and then take whatever action you decide on

    my advice though is don't upset the apple cart by giving out a dud chq (which in its own right is illegal),,, play mr nice guy,,, and then if he deserves it,,, crucify him,,

    The bloke just threatened Darren that he would lock the boat in the yard pending a court case if he reported it to police.

    Yes the loan is secured, no risk to me.
    I got more involved than necessary becuse Darren is a mate , he a chippy so needed someone to follow-up for him while he was on site over the last two weeks.
    I understand the issue of profitability for the carrier, but why all the bullshit, just tell the truth ,where the boat is and its all sweet. This blokes a grub!!!

    rando i was going to pm you some info and realised its in the office at work not home,,, but i'll post a bit of info here for the benefit of all,,,

    if undertaking finance on any chattel,, being car,, home,,, boat,,, machinery,,,or any other product,, that the financier takes a bill of sale,, or a mortgage over the purchase,,, then all of the security items that are taken are then passed to the financier,,,(that meaning you may purchase one item,,, but the financier takes more from you)

    once a bill of sale is undertaken,,, the legal ownership f the item becomes the sole property of the financier,,, the lender has obligations to keep,,, and MUST inform the financier of any change to the item that will incur any depreciated loss to the financier

    i could ramble on here for ages,,, but to make it short and sweet,,,

    i take it that the loan has been executed,,, to allow the boat to be transported,,, thus the supplier has been paid,,, i also take it as a secured loan the lender (Darren) has fulfilled his initial obligation by supplying proof of ALL requirements to have the loan settled,,, (This meaning insurance etc etc)
    Comprehensive insurance does not cover transport from the supplier to the owner,,, don't get me wrong here,,, but transport insurance does,,

    the transporter has now done what you needed,,, he has admitted that he will stow the boat if the matter goes further,,, why waste your valuable time,,, REPORT IT TO THE FINANCIER,,, they in turn have more power and money over this than you or Darren,,,

    i have documented cases on file where transport company's have been held responsible for damage,,, scratches,,, loss,,,that you would be amazed at,,, but i assure you,, its in ALL terms and conditions of any loan,,, that if the chattel that you have purchased becomes endangered, risking damage or loss, in any form,, its Darren obligation to report it to the finacier,,,

    i guarentee you,, if you used a more prelavent lender,, you'll have the boat delivered within a very short time

    DO A FULL INSPECTION OF THE BOAT,, WHEN DELIVERED,, do not sign or pay anything prior,, once this has been dropped off and the truck drives away,, its harder to document any damages or scratches without the drivers signature on a damage report

    The world needs some form of Anti-Fowl for scum like this!!!

    I would be putting a legal letter on the company directors by registered mail. That will wake the #%&ols up that's for sure. It would be worth the legal fee just for the satisfaction. If you have paid the freight, ask for your money back in writing!! they have not executed their contract....If they refuse....Call the cop's.

    I would have thought you would "have to" inform the police on this matter. If the boat gets locked up and you have not notified police and insurance....you could be even more of a victim.

    And if it makes you feel any better....I BELIEVE IN KARMA! Hope he need's a chippy and rings Darren for a job!! Nail gun, what nail gun
