I didnt know that there was whale watching in the bay! IMO that is a bit of false advertising.

There will be days when the fishing is better than one's most optimistic forecast, others when it is far worse. Either is a gain over just staying home.
It extends out 3 nautical mile from the baseline, this falls under state waters jurisdiction.
Incidently, only within this 3 nm from land or baseline are there state laws concerning marine mammals, the commonwealth doesn't have any similar legislation. There are only 3 permits for whale watching in MBMP, of which 2 are active.
