Saw this in the Sunshine coast daily today.

So easy to do in the split second you see white water or a wall of water........dead ahead...
Got to pick your time so as not going through the bar on runout tide...

the alarming thing to come out of this is that you can be charged as a recreational skipper if any of your passengers get injured. obviously the court has decided this guy acted negligently.

Wonder how much the passengers own negligence caused the injury as well. Thats what boats do going through waves and you have to brace yourself.

Sounds like a test drive with an inexperienced power boatie. Nothing about a bar, only a bigger than normal swell. Would have been a big Kevlacat I am pretty sure.

dont think my home insurance would cover me for injuring some one on my boat, but my boat insurance does.

That's a bit of a worry really, and just having gone through selling and buying a boat, it is fairly normal to push things a bit for either the seller or the buyer. In this case I guess it was fortunate for the seller that he had decent insurance cover but if not one could lose their home or whatever you own. So what do we say, "no water test unless you sign a waiver"
I am surprised an experienced boatie would, either seller or buyer would get into such an awkward situation as one would normally be better prepared for sea conditions. The whole thing seems a bit dodgy to me, I wonder if they knew each other??
I have been out many times with mates and VMR skippers and landed very hard also and never sued anyone, it's just annoying that courts fill the pockets of these opportunists at all of our expense. I know a person of the same name as the injured who I asssume to be the same person and they are very well off so it makes it more annoying....
These big payouts are just hog tying all of us making it hard to do anything >:(
