They state in the video moreton bay marine park the boundaries are not just in the bay see attached map

Quite often get whales up the top end of the bay. Winter before last there was a full pod with a couple of calves having a look around the M2 and M4 beacons.

It extends out 3 nautical mile from the baseline, this falls under state waters jurisdiction.
Incidently, only within this 3 nm from land or baseline are there state laws concerning marine mammals, the commonwealth doesn't have any similar legislation. There are only 3 permits for whale watching in MBMP, of which 2 are active.
